Article 1 (Purpose)
These Terms of Service (the "Terms") govern the rights, obligations, responsibilities, and other necessary matters between Silmaril Technologies Inc. (the "Company") and users in connection with the use of the AI-powered learning assistant service (the "Service") provided by the Company.
Article 2 (Definitions)
- "Service" means the AI-powered learning assistant platform provided by the Company, including problem recognition, step-by-step reasoning guidance, and incorrect-answer analysis.
- "User" means any member or non-member who uses the Service in accordance with these Terms.
- "Member" means a user who has entered into a service agreement with the Company and has been issued a user account.
- "Content" means all information, text, images, videos, software, and other materials provided by the Company within the Service.
Article 3 (Publication and Amendment of the Terms)
- The Company shall post these Terms on the initial screen or a linked page of the Service so that users can easily access them.
- The Company may amend these Terms within the scope of applicable laws when necessary.
- When the Terms are amended, the Company shall announce the effective date and the reasons for the amendment, together with the current Terms, on the initial screen of the Service from seven (7) days prior to the effective date until the day before the effective date.
- If a user does not agree to the amended Terms, the user may terminate the service agreement. Continued use of the Service after the effective date of the amended Terms shall be deemed consent to the amendment.
Article 4 (Provision of the Service)
- The Company provides the following services:
- Problem-photo recognition and classification
- AI-based step-by-step reasoning guidance
- Socratic hint system
- Incorrect-answer analysis and concept linking
- Learning statistics and reports
- Incorrect-answer notebook management
- The Company may change the contents of the Service to improve its quality and shall give prior notice of such changes.
- The Service is in principle provided 24 hours a day, 365 days a year; however, it may be temporarily suspended for reasons such as system maintenance.
Article 5 (Membership Registration)
- A user applies for membership by completing the registration form prescribed by the Company and by indicating consent to these Terms.
- The Company shall accept the membership application unless any of the following applies:
- The applicant has previously lost member status
- The registered information contains falsehoods, omissions, or errors
- Registering the applicant would cause substantial technical difficulty for the Company
- If any information registered at the time of sign-up changes, the member shall promptly notify the Company by updating the membership information.
Article 6 (Protection of Personal Information)
- The Company establishes and complies with a Privacy Policy to protect users' personal information.
- The Company endeavors to protect users' personal information as prescribed by applicable laws.
- The protection and use of personal information is governed by applicable laws and the Company's Privacy Policy.
- The Company shall destroy personal information without delay once the purpose of its collection has been achieved.
Article 7 (Member Obligations)
- Members shall not engage in the following conduct:
- Registering false information at sign-up or when updating member information
- Misappropriating another person's information
- Altering information posted by the Company
- Transmitting or posting information (including computer programs) other than that designated by the Company
- Infringing intellectual property rights, such as copyrights, of the Company or any third party
- Damaging the reputation of, or interfering with the business of, the Company or any third party
- Publishing or posting on the Service any obscene or violent messages, images, audio, or other information contrary to public order and morals
- Using the Service for commercial purposes
- Any other illegal or improper conduct
- Members shall comply with applicable laws, the provisions of these Terms, usage guides, service-related notices, and any matters announced by the Company, and shall not engage in conduct that interferes with the Company's business.
Article 8 (Restrictions on Use)
- The Company may restrict use of the Service if a member breaches the obligations under these Terms or interferes with the normal operation of the Service.
- Notwithstanding the foregoing, the Company may immediately and permanently suspend use in the event of violations of applicable laws, including identity or payment misappropriation in violation of the Resident Registration Act, the provision and operation of unauthorized programs in violation of the Copyright Act, or illegal communications, hacking, distribution of malicious programs, or unauthorized access in violation of the Information and Communications Network Act.
- If a member does not log in for one (1) year or more, the Company may restrict use for the protection of member information and operational efficiency.
Article 9 (Copyright)
- Copyrights and other intellectual property rights in works created by the Company belong to the Company.
- Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise commercially use information whose intellectual property rights belong to the Company, or allow a third party to do so, without the Company's prior consent.
- Copyrights in posts submitted by users within the Service belong to the authors of such posts.
Article 10 (Disclaimer)
- The Company is exempt from liability for providing the Service if it is unable to do so due to acts of God or equivalent force majeure.
- The Company is not liable for any interruption of the Service caused by a user's fault.
- The Company is not liable for any expected profits that users fail to obtain or lose through use of the Service.
- The Company is not responsible for the reliability or accuracy of information, materials, or facts posted by users on the Service.
- Given the nature of AI-based learning services, the solutions and explanations provided may contain errors, and the Company assumes no legal liability in this regard.
Article 11 (Dispute Resolution)
- The Company shall establish and operate a complaint-handling facility to reflect legitimate opinions or complaints from users and to compensate for any damages.
- The Company shall give priority to handling complaints and opinions submitted by users.
- If a user files a damage-relief application regarding an e-commerce dispute between the Company and the user, the dispute may be subject to the mediation of a dispute-mediation institution designated by the Fair Trade Commission or a metropolitan or provincial governor.
Article 12 (Governing Law and Jurisdiction)
- The laws of the Republic of Korea shall apply to the interpretation of these Terms and to any disputes between the Company and users.
- Any litigation arising between the Company and users in connection with use of the Service shall be brought before the court of competent jurisdiction under the Civil Procedure Act.
Supplementary Provisions
- These Terms take effect on February 1, 2026.
- These Terms shall also apply to members who joined before the effective date.
